Bicycle Injuries

Bicycle injuries are a common occurrence and the result of a careless or negligent driver. Common bicycle injuries result from distracted driving, drunk driving, reckless behavior, opening door accidents, road rage, speeding, and unsafe road conditions. If you are injured in a bicycle accident, you must get immediate medical attention, even if injuries aren’t immediately apparent because some injuries may have been delayed. It is important to remember that in California, the statute of limitations for bicycle accident cases is two (2) years.

Determining who is at fault in a bicycle accident can be tricky. Motorists may be held responsible for negligent actions such as failing to give cyclists enough space, texting while driving, or not using turn signals. Pedestrians can be liable if their actions, like suddenly stepping into a bike lane, cause an accident. Product manufacturers may be held accountable for defective bicycles or parts under product liability laws. Local governments or agencies could be responsible if unsafe road conditions contributed to the accident.

Like all injury claims, and after obtaining appropriate medical attention, gathering evidence is vital. This includes photographing the scene, collecting contact information from witnesses, and obtaining a police report. It’s important to avoid admitting faults, as even a courteous apology could be construed as an admission of responsibility.

To establish liability, it must be proven that the responsible party owed a duty of care, breached that duty, and that this breach led to the accident and resulting injuries. Compensation in bicycle accident cases may cover a range of damages, including medical expenses (current and future), lost wages, pain and suffering, and loss of quality of life. The specific damages awarded depend on factors such as the severity of injuries, which can range from road rash and broken bones to traumatic brain injuries and spinal cord damage.
